These Terms of Service ("Terms" or "TOS") govern your access to and use of the Site, including any content, functionality, services, applications (including any white-labeled versions thereof), software platforms, and products offered thereon (collectively, the "Services").
The Services include, but are not limited to, information and tools related to direct-to-consumer mortgage solutions, lease-to-own options, commercial real estate services, licensed and non-licensed products, third-party applications or embedded content, and our software platform that may be white-labeled for use by partners.
By accessing or using the Site or Services, you agree to be bound by these Terms, our Privacy Policy, our California Privacy Policy, and any additional terms or policies referenced herein, including any Master Subscription Agreement or Order Form if applicable to your use. If you do not agree to these Terms, you must not access or use the Site or Services.
These Terms apply to all visitors, users, subscribers, partners, white-label licensees, and others who access or use the Site or Services ("Users," "Subscribers," "Partners," or "you"). You represent and warrant that you are at least 18 years old, a resident of the United States, and have the legal capacity to enter into these Terms. If you are accessing the Site or Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.
We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or Services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

1. Description of Services
Roxford provides informational resources, tools, and services related to mortgages, real estate, lease-to-own programs, commercial financing, and related products. Some Services may involve third-party applications, embedded content, or links to external sites. 2. Subscriptions and SaaS Access
Certain Services, including access to our software platform, are provided on a subscription basis ("Subscription"). Subscriptions may be governed by a separate Master Subscription Agreement ("MSA") or Order Form, which is incorporated herein by reference.
3. User Accounts and Obligations
To access certain Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Data Ownership and Handling
You own your data submitted to the Services ("Customer Data"). You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, distribute, create derivative works of, and display Customer Data to provide and improve the Services, offer related products, and for aggregated, anonymized analytics, subject to our Privacy Policy.
5. User-Generated Content
If you submit content (e.g., documents, reviews, comments) via the Site or Services ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, distribute, modify, and display it for business purposes, subject to our Privacy Policy.
6. Intellectual Property
The Site and Services, including all text, graphics, logos, software, platform code, and content ("Content"), are owned by Roxford or its licensors and protected by copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Content for your subscribed purposes only, subject to these Terms.
7. Third-Party Content and Links
The Site may contain links to third-party websites, apps, or services (e.g., embedded tools or payment processors). We do not control or endorse these third parties and are not responsible for their content, privacy practices, availability, accuracy, legality, or reliability. 8. Disclaimers and Warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, FUNCTIONALITY, OR UNINTERRUPTED USE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROXFORD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
10. Indemnification
You agree to indemnify, defend, and hold harmless Roxford, its affiliates, officers, directors, employees, agents, licensors, suppliers, and assigns from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from your use of the Site or Services.
11. Termination
We may terminate or suspend your access to the Site, Services, or Subscription at any time, without notice or liability, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site and Services ceases immediately.
12. Electronic Communications and Signatures
By using the Site or Services, you consent to receive all communications, notices, agreements, disclosures, and other documents electronically, including via email, text message, in-app notifications, or postings on the Site. You agree that electronic Communications satisfy any legal requirement that such communications be in writing.
13. Telephone and Text Communications
By providing a telephone number (mobile or landline) or email address, you expressly consent to receiving communications from us, our affiliates, agents, or partners, including autodialed calls, prerecorded or artificial voice messages, texts (SMS/MMS), emails, or faxes, for account servicing, marketing, or informational purposes.
14. International Use and Export Controls
The Services are intended for users in the United States only and may not be available or appropriate elsewhere due to licensing and regulatory limits. You represent you are not in a sanctioned country or on a US prohibited list (e.g., OFAC). You agree to comply with US export laws.
15. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes arising under these Terms shall be resolved exclusively through binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association.
16. Miscellaneous
If any provision of these Terms is held invalid, the remainder shall remain in effect. No waiver of any term shall be deemed a further or continuing waiver. These Terms, together with our Privacy Policy, any MSA, Order Forms, and referenced documents, constitute the entire agreement between you and us.
